- An inconvenient or costly clause is not automatically invalid.
- Review individual terms and agree on clear wording before signing.

I signed the extra clauses. Must I follow every one?

A signature cannot validate a term that unlawfully removes tenant protection.

Can I cross out everything that seems unfair?

Check each clause first. Agree on changes and keep a copy.
Extra terms do not automatically override the law
- Contract terms
- Legal requirements
- Statutory rights
Special clauses are additional promises written into a lease. Article 10 of Korea’s Housing Lease Protection Act makes terms ineffective when they conflict with that Act and disadvantage the tenant. Signing or stamping the agreement does not remove that protection.
Both conditions matter: identify the legal provision being contradicted and how the term disadvantages the tenant. First establish that the Act applies to the residential tenancy and consider the actual contractual circumstances.
Distinguish waived rights from ordinary house rules
- Statutory rights
- House rules
- Scope
A blanket waiver of a legally protected renewal right at the start of a tenancy may conflict with Article 10. Whether that right remains available, a statutory refusal ground exists, or a separate agreement provides substantial compensation still requires individual assessment.
No-smoking rules, instructions for equipment and returning keys are not automatically invalid because they are inconvenient. Repair and cleaning clauses also need assessment of their wording, scope and circumstances. Neither “special terms always win” nor “all unfavourable terms are void” is reliable.
Replace vague wording with a clear agreement
- 01Contract terms
- 02Clear wording
- 03Agreed terms
For wording such as “the tenant pays all costs,” ask which costs, when they arise and how they are calculated. Record the agreed scope and have both parties confirm amendments. Keep matching copies of the final contract.
If you have already signed, crossing out a sentence alone does not settle its legal effect. Compare it with the relevant rule and keep your request for correction or non-enforcement. A dispute over one clause does not justify simply stopping separate obligations such as rent.
What to check
- Read every extra clause before signing.
- Mark rights waived, costs allocated and when each term applies.
- Identify the specific legal rule relevant to a disputed clause.
- Keep agreed amendments and the complete final contract.
Common questions
Does a handwritten clause outrank legal protection?
No. The writing format cannot cure a conflict with a mandatory tenant-protection rule.
Does one invalid clause cancel the whole lease?
Not automatically. The effect on that clause and on the remaining contract must be considered separately.
