SORA RENTAL NOTE · 02

Moving out before the lease ends:
when do rent and your deposit settle?

The day you remove your belongings, the day a new tenant arrives and the day your lease ends may all be different. Start by identifying what determines your final rent payment and deposit-return date.

Start with the comic

A student packing boxes asks Sora, who is holding the lease, about moving out.
01
Does moving out end the lease?

Your moving date and lease end date can differ. First check the current status of your contract.

A student and Sora examine a lease and calendar together.
02
Which termination rule applies?

For a fixed term, check the early-termination clause, legal grounds or an agreement. Renewal can lead to different rules.

A landlord reads the notice sent by the student.
03
Record when notice is received

After implicit renewal, a tenant's termination takes effect three months after the landlord receives the notice.

A tenant and landlord confirm deposit repayment while handing over the keys.
04
Coordinate payment and handover

Put the end date, rent and fee settlement, and deposit return in writing. Coordinate them with handing back the home.

This comic illustrates an example. Read the article below for the specific requirements and exceptions.

THE SHORT ANSWER

Separate your moving date from your lease end date.

A visual guide to this section
  • Actual moving date
  • Lease end date
Check these points together. The explanation below gives their relationship and conditions.
  1. 01

If your original fixed term has not expired

A fixed-term lease normally ends when the agreed period expires. Unless you have an early-termination clause, a statutory ground for termination or an agreement with the landlord, removing your belongings does not automatically end the lease or your obligation to pay rent.

  2. 02

If you and the landlord agree to an early end

The final day for rent and management fees, the deposit-return date and the key-handover date depend on the agreement both parties have confirmed. If you agree that the lease ends when a new tenant moves in, that date matters. It is not an automatic legal rule for every lease.

  3. 03

If the lease renewed implicitly or through your statutory renewal right

You may give notice of termination at any time. It takes effect three months after the landlord receives your notice. You can agree on an earlier date, but failure to find a replacement tenant does not automatically extend that statutory three-month period.

The key point: when you move out early, the agreed rent is generally assessed up to the date the lease legally ends or ends by agreement. If you continue using the home after termination, payment for that use may still be an issue. Deposit return and handing back the home must be coordinated.

FIND YOUR CONTRACT TYPE

Which row describes your lease?

How the contract type affects the end date and rent
Current contract statusWhen it endsWhat to check
Original fixed-term leaseNormally on the agreed expiry date; an early-termination clause, statutory ground or separate agreement may change thisSpecial terms in the lease and whether the landlord has agreed to an early end
Termination by agreementOn the end date agreed by the landlord and tenantWhether the end depends on a new tenant moving in or is a definite calendar date
Implicit renewalThree months after the landlord receives the tenant's termination noticeEvidence of what the notice said and when it actually reached the landlord
Renewal after exercising the statutory right to request renewalThree months after the landlord receives the tenant's termination noticeEvidence that the statutory renewal right was exercised and of when the notice was received
A new fixed term agreed in a new contractDepends on the wording and circumstances of the new agreementFirst establish whether this was a statutory renewal or an ordinary new agreement

A newly signed document cannot be classified simply because its heading says “extension agreement.” If the type of renewal or the wording is unclear, have the actual contract reviewed.

DEPOSIT & KEY HANDOVER

For deposit return, start with the lease end—not the next tenant.

  • Lease end date
  • Room handover
  • Repayment responsibility
Check these points together. The explanation below gives their relationship and conditions.

Once the lease has validly ended, the tenant must return the home and the landlord must return the deposit. These obligations are linked. In practice, agree on specific times on the same day for the move-out inspection, key handover and deposit transfer.

01

Set a definite end date

Record the date, time and bank account for deposit return. Avoid open-ended wording such as “when the room is re-let.”

02

Separate the different charges

Distinguish the final day for rent and fixed management fees from the meter-reading date for usage-based electricity, gas and water charges.

03

Coordinate payment and handover

Check the room's condition and supplied items together. Put confirmation of the deposit transfer and key handover into one agreed sequence.

If the lease has ended but the deposit has not been returned

  • Moving out or changing your registered address before receiving the deposit can affect your ability to maintain opposability and preferential-payment rights.
  • If you must move first, consider a court-ordered leasehold registration (임차권등기명령).
  • Filing the application is not enough. Confirm that the leasehold registration has actually been completed in the property register before handing back the home and transferring your registered address.
  • If a substantial sum is involved or a repayment dispute has begun, bring the lease and notice records to a legal professional for advice on your case.

Foreign tenants should check the address-registration requirements applicable to their status; see Guide 12: reporting for foreign tenants.

WRITE IT DOWN

Keep a written record of these six points.

A visual guide to this section
  • Lease dates
  • Monthly rent
  • Deposit deductions
Check these points together. The explanation below gives their relationship and conditions.
  1. Contract status

    Original lease or renewed lease?

Check the term, how the lease was renewed and any early-termination clause first.

  2. Receipt of notice

The received date matters more than the sent date

Send your intention to leave and preferred date by a method that keeps a record, such as text, KakaoTalk or email. Keep the landlord's acknowledgment. If a dispute is likely, consider content-certified mail (내용증명) together with proof of delivery (배달증명), so you can show both the notice's contents and its receipt.

  3. End date

Turn “when someone new arrives” into a clear condition

Specify whether you mean the new tenant's signing date or actual move-in date, and whether you may leave before that date.

  4. Charges

Separate rent, management fees and utilities

Check any daily proration, fixed management fees, usage-based utilities and restoration obligations item by item. If you have discussed who pays the brokerage fee for a replacement tenant, record that agreement too.

  5. Deposit

Return date, time and bank account

If deductions are proposed, check their reasons and amounts in advance. Agree on the sequence for confirming payment and then handing over the keys.

  6. Evidence

    Keep photographs and messages together

Save move-in and move-out photos, meter readings, the lease, transfer records, notices and agreement messages in one folder.

MESSAGE TEMPLATE

Be specific when writing to your landlord

“I am the tenant of unit [number]. I would like to confirm my current contract status and the conditions for moving out early. My preferred move-out date is [date]. I would like us to confirm in writing the lease end date, the final date for rent and management fees, the deposit-return date and the time for handing over the keys. Please review these points and reply.”

The result depends on the contract. This is an example for starting a written discussion, not a completed legal termination notice for every situation.

FREQUENTLY ASKED

Four common questions about leaving early.

Can I stop paying rent on the day I remove my belongings?

No. If you are still within the original fixed term, moving out alone does not automatically terminate the lease. First check any early-termination clause, statutory ground for termination or agreement with the landlord.

Do I only have to pay rent until a new tenant moves in?

This is not a rule for every situation. It may be an important condition if you and the landlord agreed to it for an early end to a fixed-term lease. However, an implicitly renewed lease or a lease renewed through the statutory renewal right has a separate rule: termination takes effect three months after the landlord receives notice.

When does an implicitly renewed lease end?

The tenant may give termination notice at any time. Termination takes effect three months after the landlord receives it. If you agree on an earlier end date, record that date and the settlement terms in writing.

Can I move first if my deposit has not been returned?

Moving out or transferring your registered address can affect existing opposability and preferential-payment rights. If you use the leasehold-registration-order procedure, confirm actual completion of the registration before moving; the application date alone is not enough.
