Wrong address or unit number?
Your deposit protection may be at risk.

Even after you move into a studio near Korea University and register your address, the record must identify the home you actually rent. A wrong building address is different from a wrong unit number, and the result can differ between a single-title multi-household building and individually titled flats.

THE SHORT ANSWER

Yes, it can cause a problem. One typo does not automatically mean you lose your deposit.

Under the Housing Lease Protection Act, taking possession of the home and completing valid resident registration enables a tenant to assert the lease against third parties from the following day. This protection is often called opposability. Whether the registration validly gives others notice of the rented home depends on the building type, the address recorded and whether third parties can identify the property.

For priority repayment ahead of junior rights holders in a court or public auction, the tenant also needs a fixed date on the lease (확정일자), in addition to those possession and registration requirements. A fixed date alone does not cure an incorrect registered address.

Practical rule: Compare the address on the lease, property register and building register with the actual entrance and your resident-registration record. If the property and building registers differ, do not assume that one always takes precedence. Check how the address changed and whether the records adequately identify the home.

The cases below concern Korean resident registration. Foreign residents should confirm their applicable immigration address record and correction procedure. Registered foreigners generally report a change of place of stay within 15 days of moving; this differs from a Korean citizen's 14-day move-in reporting procedure. See Guide 12 for the distinction.

BUILDING TYPE MATTERS

A wrong building address and a wrong unit number need different checks.

SituationWhy it mattersFirst step
You registered the address of a different buildingThe record may not identify the home you actually rent, putting your ability to assert the lease against third parties and claim priority repayment at risk.Immediately compare the registered address, actual building and official records. Ask the competent community center how to correct the resident-registration record.
Wrong building or unit number in individually titled flats (다세대주택)Where units are separately registered, a record that fails to identify the particular privately owned unit may not give legally effective notice.Compare the building and unit numbers on that unit's property register and the resident-registration record.
Wrong unit number in a single-title multi-household building (다가구주택)Supreme Court decisions recognize that a unit-number error alone need not defeat protection if the building address is correct. Confirm the legal building type and actual residence.First check the building register and how ownership is registered. Then make sure the lease and identifying labels accurately identify the room.

A REAL COURT EXAMPLE

What if the building later changes to individually titled flats?

  • Individual unit title
Check these points together. The explanation below gives their relationship and conditions.

In Supreme Court decision 99Da15597 of September 3, 1999, a tenant rented a home still under construction that had been approved as a single-title multi-household house. The tenant registered only the land-lot address. The building later became a block of individually titled flats, with each unit separately registered. A mortgage was registered before the tenant corrected the address, and the tenant could not claim priority over that mortgage holder. Correcting an address does not automatically restore an earlier priority date against intervening rights. The Court also noted that special circumstances, such as whether the registered address was based on the building register, need separate consideration.

By contrast, Supreme Court decision 97Da29530 of November 14, 1997 held that registration at the correct land-lot address of a single-title multi-household house could provide effective notice even if a unit number used for convenience was entered incorrectly. Together, these cases show why “a wrong unit number always invalidates protection” is too broad a conclusion.

Remember this when viewing a studio in Anam.

  • Do not decide whether a building is single-title or individually titled from its appearance or name alone.
  • A number such as “201” on the door may differ from the registered unit number. Compare the documents.
  • Even if a court decision suggests that a unit-number error does not affect protection, promptly correct an inaccurate description of the rented property.

WHAT TO DO NOW

If your registered address is wrong, check it immediately.

Steps to check
  1. 01Property records
  2. 02Actual home
  3. 03Check facts and correct
Read the explanation below for the conditions at each step.
  1. 01 · RECORD

Check the address on the completed registration record.

Do not rely only on the application screen. After processing, check the address, building number and unit number shown in the resident-registration record.

  2. 02 · REGISTERS

Check the building and relevant property registers.

Confirm whether this is a single-title multi-household house or a building of separately registered flats. Check whether the address has changed over time.

  3. 03 · CORRECT

Contact the competent community center without delay.

If your registered address differs from the home you occupy, confirm how to correct it and when the correction will be processed. Check the record again afterward. If priority between competing rights is at stake, seek an individual professional review. Foreign residents should check with the authority responsible for their applicable immigration address record.

  4. 04 · KEEP

Keep the lease, fixed-date record and move-in evidence together.

If you and the landlord have inconsistent descriptions of the rented property, keep a signed correction document. Preserve the lease's fixed date and evidence of when you actually moved in.

FAQ

Frequently asked questions

Does correcting my address always make protection effective from the original reporting date?

No. Priority may depend on whether the original registration gave valid notice of the lease and whether other rights arose before the correction. In decision 99Da15597, the tenant did not have priority over a mortgage registered before the address was corrected.

Will I lose deposit protection if only the unit number is wrong in a single-title multi-household house?

Not necessarily. A court decision accepted an incorrect unit number where resident registration used the correct land-lot address of a single-title multi-household house. The actual building address, possession of the home and residence still need separate verification.

Is an address error harmless if I already have a fixed date?

No. A fixed date is one requirement for priority repayment. You also need to meet the requirements of possession of the actual home and valid address registration.
